New South African Immigration Act 2002

 

  1.         VISITORS VISAS

           

A visa only enables the holder to proceed to a port of entry before or on the expiry date of the visa, where the holder must comply with the applicable law, regulations and entry requirements.Where a visa was issued outside the Republic, upon admission such visa shall be considered to be a permit.  The period of validity of such a permit shall be calculated from the date of admission and shall not exceed three months.  The period for processing visa is ten days. Only bank guaranteed cheques or money orders made payable to the South African High Commission are accepted. Annexure 2 (Application for a visa) should be completed for both Visitors and Transit Visa

1.1       Documents and other information required in respect of  Visitor Visa for visits less than 90 days     

 

q       Passport valid for no less than 30 days after the expiry of the intended visit  

q       Payment of the prescribed fee of C$79-00, if   applicable payable by money order a bank draft only (no personal cheques accepted) Subject to change.

q       Proof of financial means in the form of:

o       Bank statements

o       Salary advice

o       Undertaking by the host in South Africa

o Copy of host proof of SA citizenship/ Permanent residence /Valid residence permit.

o       Medical cover

o       Cash available including, credit cards or travelers’ cheques, to cover the envisaged living expenses during the sojourn to South Africa

 

q       Proof of booking of a return air-ticket.  A refundable cash deposit of C$1000-00 may in some instances be requested.  After returning from South Africa the deposit will be refunded on presentation of the original receipt, provided visa conditions have not been violated.  

q       Proof of accommodation/ letter of invitation from the South African contact person / Hotel confirmation  

q       Two identity photos  

q       Statement and/or documentation confirming purpose of visit - On request

1.2       DOCUMENTS AND OTHER INFORMATION REQUIRED IN RESPECT OF TRANSIT VISA

q       All items in 1.1 above, excepting proof of financial means and statement and/or documentation confirming purpose of visit

q       Proof of admissibility in the foreign country

 

 

2.         TEMPORARY RESIDENCE PERMITS

 

Annexure 14 (application for temporary residence permit) should be completed for all categories of permits or visits to South Africa of more than three months.  The following are different types of permits falling under  this category.

2.1       WORK PERMIT

The Immigration Act, 2002 provides for the following different categories of work permits.

q       passport Valid for no less than 30 days after the expiry of the permit. 

q       payment of the non-refundable application fee of $283

q       medical certificate in respect of applicant and accompanying family members

q       unabridged Birth Certificates to prove parenthood for children accompanying the applicant

q       marriage certificate, where applicable

q       proof of spousal relationship, where applicable

q       divorce decree, where applicable

q       proof of custody, where applicable

q        proof of adoption, where applicable

q       Proof of legal separation, where applicable

q Medical + Radiological reports

q       police clearance certificate in respect of all applicants 21 years or older, in respect of all countries where person(s)resided one year or longer, to be submitted within twelve months of the application if not immediately available

q       proof of booking of a return air-ticket or cash deposit of C$1000-00, refundable only if visa/permit conditions have not been violated and the original receipt is presented

2.2                   Work Permit (General Quota)

 

DOCUMENTS AND OTHER INFORMATION REQUIRED IN RESPECT OF THIS APPLICATION

 

q       all the requirements in 2.1 above, where applicable

In addition the following requirements or conditions should be met

 

q       an offer of employment

 

q       submission of a certificate of a Chartered Accountant confirming that applicant under this category of work permit are to be employed on terms and conditions not inferior to those offered to citizens and residents or prevailing in the relevant market segment taking into account collective bargaining agreements and other standards, if any;

 

q       commitment by the employer to comply with the requirement, in respect of a foreigner issued with the quota permit, to pay a training fee in respect of the applicant amounting to two percent of his or her taxable remuneration to be paid quarterly in advance.  The Minister of Home Affairs shall determine the revision and the manner in which this money will be collected.

 

q       Certification by a Chartered Accountant, that the terms and conditions under which the employer intends to employ the applicant (candidate), including salary and benefits, are not inferior to those prevailing in the relevant market segment for citizens and residents, taking into account applicable collective bargaining agreements and other applicable standards, as recorded by the Department of Labour, if any, provided that;

 

o       a copy of such certification shall be conveyed to a prescribed office of the Department of Labour and;

o       such certification shall lapse if objected to for good cause by such office of the Department of Labour within 15 calendar days of its receipt

2.3       Work Permit (Extraordinary Quota)

 

A quota work permit may be issued to an applicant who has skills or qualifications which fall within a category determined by the Minister of Home Affairs by public notice in the government gazette on recommendation of the board and after consultation with the Ministers of Labour and Trade and Industry, under the following provisions;

 

q       the number of quota work permits issued may not exceed set out in such notice for each category set out in such notice

q       In making its recommendation, the Board shall give due consideration to the objectives of the Act, and shall satisfy itself certain needs of the of the economy require resorting to quota work permits in terms of the other provisions of this regulation;

q       The foreigner issued with a quota work permit in terms of the paragraph shall be authorized to conduct work;

o       even when at the time the permit is issued he or she does not have a prospective employer;

o       outside of such category, unless the Minister determines otherwise in such notice

o       without complying with the requirements set out in the regulation, save that within thirty calendar days of such foreigner becoming employed in terms relevant sub-regulations, referring to certificate by a Chartered Accountant shall be complied with

2.4       Work Permit (General)

 

A general work permit may be issued to an applicant not falling within a category of a quota work permit.

 

DOCUMENTS AND OTHER INFORMATION REQUIRED IN RESPECT OF THIS APPLICATION

 

q       All applicable requirements under 2.1 above,

q       submission of the original advertisement in the national printed media, which must comply with the following

 

q       a letter accompanied by documentary proof of the efforts made to obtain the services of a citizen or resident, including the original advertisement in the national print media, details of citizens and or residents who applied and the reasons why they did not qualify;

the advertisement required shall be an original clipping from the national print media and shall comply with the following

 

o       The specimen must reflect the full particulars of the relevant newspaper or specialized magazine, as well as the dates on which the advertisement was published

o       Such advertisement must stipulate the minimum qualifications and experience required to fill the position as well as the remuneration and benefits offered

o       The position offered and responsibilities to be performed must be clearly defined

o       Such advertisement should measure at least 150 millimeters by 90 millimeters

o       The closing date for the application must be stated in the advertisement

o       The advertisement may not be older than 3 months at the time of application

 

q       Submission of an employment contract containing the signatures of both the employer and the employee and the applicable terms and conditions of employment

 

q       proof that all short-listed candidates have been interviewed

 

q       Certification by a Chartered Accountant, that the terms and conditions under which he or she intends to employ the applicant (candidate), including salary and benefits, are not inferior to those prevailing in the relevant market segment for citizens and residents, taking into account applicable collective bargaining agreements and other applicable standards, as recorded by the Department of Labour, if any, provided that;

 

o       a copy of such certification shall be conveyed to a prescribed office of the Department of Labour and;

o       such certification shall lapse if objected to for good cause by such office of the Department of Labour within 15 calendar days of its receipt

o       a Chartered Accountant certification must also contain information regarding the job description and that the position exists and is intended to be filled by such applicant (candidate)

 

q       In the case of senior position, reasons for not filling the position by the promotion of existing personnel

 

q       Undertaking to register with the professional body, or board or council in South Africa, where applicable

 

q       The employer must produce independent and reliable certification of the applicant’s relevant skills, qualifications or experience and a statement explaining the correlation between the qualifications and requirements of the position and such foreigner’s relevant skills, qualifications or experience, which certification may be included in the certification contemplated in (v) above.

 

q       Letter of approval, where required by law from

 

o       The relevant professional body/board/council

o       The Department of Labour

o       The relevant organ of state

2.5       Work Permit (Exceptional Skills)

 

q       all requirements under item 2.1, where applicable

 

q       a letter from a foreign or South African organ of State, or from an established South African academic, cultural or business body, confirming the applicant’s exceptional skills or qualifications,

q       Testimonials from previous employers, if applicable, and a comprehensive curriculum vitae,

q       Other proof to substantiate exceptional skills or qualifications, such as publications, and testimonials

2.6       Work Permit (Intra Company Transfer)

 

q       all requirements under item 2.1, where applicable

q       a letter from the international concern confirming that the foreigner will be transferred to a branch/affiliated South African Company

q       A letter from the South African Company confirming the transfer of such foreigner from parent/affiliated company abroad, as well as specifying the occupation and capacity in which the foreigner will be employed, and that the maximum duration will not exceed two years

q       a certification by a chartered accountant acting on behalf of the employer that the employer needs to employ such foreigner within South Africa  and outlining the foreigner’s job description

q       undertaking by the employer to take adequate or prescribed measures to ensure that such foreigner will at all times comply with the provisions of the Act, and will immediately notify the Department if it has reason to believe otherwise

q       Financial guarantee by the employer in South Africa in the form of a deposit   which shall not exceed the sum of the following amounts

o       The cost of a single ticket to the country of origin

o       The cost of a return ticket to the country of origin of the foreigner for an escort

o       The detention and related costs of the illegal foreigner and;

o       Subsistence and travel costs and allowances for escort

q       OR an undertaking by the employer to the effect that the amounts envisaged in regulation 20 shall be paid to Department in the event of the foreigner’s deportation from South Africa.

2.7       Work Permit (Corporate Worker)

(Section 21.1)

 

q       all applicable requirements under A, where applicable

q       Corporate permit holder’s (employer) letter specifying the reference number of the corporate permit, the fact that the person is employed under a corporate permit, the occupation and capacity in which the applicant will be employed, and his or her remuneration

q       Certification by the permit holder (employer) that to the best of his/her knowledge such application is consistent with the terms and conditions of such corporate permit, Act, and Regulations

2.7.1    In respect of work permit (corporate worker) (section 21.4b) in terms of which the Government of South Africa enters into an agreement with one or more foreign states and sets as the condition that its holder (employer);

 

q       Employs foreigners partially, mainly or wholly from such foreign countries

q       Remits a portion of the salaries of such foreigners to such foreign countries

 

The following documents and information is required for this category of work permit (Corporate Worker)

 

q       Passport valid for less than 30 days after the expiry date of the intended stay

q       A full set of fingerprints

q        A valid employment contract entered into and attested in the worker’s country of origin for a maximum period of 18 months

q       Permission from the Department of Labour (no objection permit, BI-17), submitted by the employer or his or her agent, where applicable, unless the employer or recruiting agent is exempt from this requirement by the Department, the Minister of Energy, the Minister of Agriculture or the Minister of Trade and Industry

q       An undertaking by the proposed employer, that he/she will remove the worker to his/her country of residence on completion or expiry of the contract

q       Permit holder (employer) certification, that to the best of his/her knowledge such application is consistent with the terms and conditions of such Corporate Permit, the Act and its Regulations

2.7.2    WORK PERMIT (CORPORATE WORKER) in respect of seasonal labour (section 21.4C)

 

In consultation with the Minister of Trade and Industry or Minerals and Energy or Agriculture, as the case may be, the Minister of Labour may designate certain industries, or segments thereof, in respect of which the Government may apply this subsection in respect of foreigners required for seasonal or temporary peak period employment.

 

Documents and other information required in respect of  this type of applications

 

q       Passport valid for no less than 30 days after the expiry date of the intended stay

q       A full set of fingerprints

q       A valid employment contract, which has been entered into and attested in the prospective worker’s country of origin, for a maximum period of 6 months

q       An undertaking by the proposed employer, that he/she will remove that worker to his/her country of residence on completion or expiry of the contract

q       Permission from the Department of Labour (no objection permit, B1-17), submitted by the employer or his or her agent, where applicable, unless the employer or recruiting agent is exempt from this requirement either in terms of the relevant international agreement or by the Department, the Minister of Energy, the Minister of Agriculture or the Minister of Trade and Industry

q       Corporate permit holder’s  (employer) certification, which shall be submitted to the Department of Home Affairs, that to the best of its knowledge such application is consistent with the terms and conditions of such corporate permit, the Act and its Regulations.

2.7.7    CORPORATE PERMIT  (CORPORATE APPLICANT)

 

q       Documents and other information required in respect of this type of application

 

q       Certification prepared by the Chartered Accountant, on the basis of the relevant prescription or information of the Department of Labour, if any, that at any given time the relevant foreigners are employed on terms and conditions not inferior to those offered to citizens and residents or prevailing in the relevant market segment, taking into account collective bargaining agreements and other standards, if any.  The certificate should contain the organizational diagram of the relevant productive unit, including the staff’s residential status and job’s description

 

q       Undertaking by the corporate permit that it will;

 

o       take adequate or prescribed measures to ensure that any foreigner employed in terms of the corporate permit will at any time comply with the provisions of the Act and corporate permit;

 

o       immediately notify the Department if it has reason to believe that such foreigner is no longer in compliance with above paragraph

 

 

q       Training fee and/or an undertaking to implement the training programme for citizens and residents aimed, to the satisfaction of the Department, at reducing the corporate applicant’s dependency on foreign labour and/or at transferring skills from foreigners to residents and citizens, if any.

q       Undertaking by the corporate applicant, to ensure;

 

o       that the passport(s) of the foreigner/s are valid for no less than 30 days after the expiry date of the intended stay,

o       that foreigners are only employed in the specific positions as authorized by the corporate permit and

o       the forthwith departure of such foreigner from South Africa on completion of their tour of duty

 

q       Corroborated representations made by the corporate applicant in respect of the need to employ foreigners, their job descriptions, the number of citizens or residents employed and their positions, and other prescribed matters,

q       Undertaking by the corporate applicant to provide training programme to South African citizens and residents in order to reduce its dependency to foreigners and payment of the prescribed training fee per foreigner to the Department of Home Affairs.

3.         STUDY PERMIT

 

STUDY PERMIT REQUIREMENTS/STUDY EXCHANGE PERMITS
The following documents must be submitted with your completed application:

. BI 1738 form
. valid original passport
. full birth certificate of applicant (minors under 18 years of age) which reflect the names of both parents
. passport photograph
. flight intinerary
 . fee of $79 CDN payable by money order or bank draft only to the SA High Commission/ SA Consulate-General dependent on where application is submitted
. police clearance certificate (criminal records check for applicants 18 and older.)
. medical certificate (downloadable form (BI 811) to be completed by your general practitioner and applicable to all applicants)
. Radiological Report (downloadable from (BI 806 and applicable to all applicants over 12 years of age)
. letter of acceptance from the SA university/educational institution
. letter from Canadian university/education institution confirming official exchange ( if applicable)
. notorised letter of consent signed by both parents for applicants under 18 years of age
. proof of accommodation whilst in South Africa
. proof of sufficient funds
. proof of medical coverage for period in South Africa
. return prepaid Xpress Post envelope for the return of your passport

A deposit in the amount of $1000 CDN (money order or bank draft only) will be payable to the South African High Commission for all periods of study exceeding twelve months.  This amount will be refunded on the applicant’s permanent return to Canada as long as the conditions of the permit, or subsequent permits are not violated.

4.2 EXCHANGE PERMIT –(section 22b)

Exchange Work Programme

 

 

q       Passport valid for no less than 30 days after expiry of intended visit

 

q       Payment of a non-refundable application fee of

 

q       Proof of financial means in the form of bank  statements, salary advices, bursaries, cash available etc.

 

q       return air-ticket or cash deposit of C$1000-00, refundable only if visa/permit conditions have not been violated and the original receipt is presented

q       A letter from a prospective employer certifying that the applicant, who is under 25 years of age has received an offer to conduct work for no longer than one year. 

q       The prospective employer certifies that the position exists, and has committed himself or her to,

o       pay such foreigner remuneration which complies with applicable legal requirements

o       Provide for the welfare and the needs of such foreigner while in South Africa under the aforesaid permit

o       Report to the department the failure of the foreigner to comply with the terms of his or her permit or to depart when so required

 

q       This type of exchange permit may be issued provided;

 

o       The foreigner may not conduct work other than work for which the permit is issued,

 

o       The foreigner may not qualify for a temporary or permanent residence permit until he or she has spent two years outside South Africa, which requirement may be waived by the Department of Home Affairs in extraordinary circumstances.

5.   BUSINESS PERMIT

 

Business Permit is applicable for business activities of longer than three months.  Annexure 14 (APPLICATION FOR TEMPORARY RESIDENCE), must be completed.

 

Business permit may be issued for more than one entry, if multi entries into the Republic by that over a period of time are necessary. A business permit shall be issued to a foreigner intending to establish, or invest in a business in South Africa in which he or she may be employed.  The business permit can be issued to members of such a foreigner’s immediate family in accordance with the following requirements; 

 

q       passport valid for no less than 30 days after the expiry of  the permit

 

q       payment of the non refundable application fee of  C$251-00 per applicant

 

q       proof of booking for a return air-ticket or cash deposit of C$1000-00, refundable only if visa/permit conditions have not been violated and the original receipt is presented

q       proof of financial means in the form  

o       Bank Statements

o       Salary advice

o       Cash available, including credit cards or traveler’s cheques

to cover envisaged living expenses during the sojourn in the Republic and proof of available funds to establish a business for transfer to South Africa from abroad

 

q       certification by a chartered accountant to the effect that at least two of the following criteria are met, one of which shall be;

 

o       at least R2 500 000-00 value invested as part of the book value of the business

o       business track record to prove entrepreneurial skill

o       proof that the business contributes to the geographical spread of economic activity

o       proof that at least five citizens or residents shall be employed

o       proof that the business in question is in one of the following sectors

 

§         information & Communication technology

§         Clothing textile

§         ©   Chemicals & biotechnology

§         Agro-processing

§         Metals and Minerals

§         Automotives and Transport

§         Tourism

§         Crafts

 

o       the export potential of the business

o       calls for or involves a transfer of technology not previously generally available in the Republic

 

q       The financial or capital contribution envisaged for the establishment of a business shall originate from abroad and may include intangibles generally accepted in terms of accounting principles as business assets, and shall be in the form of foreign capital

 

q       Undertaking to register with the appropriate statutory body, if required by the nature of the business

 

q       Business permits may be issued as valid for 24 months at a time

 

q       If applicant is accompanied by spouse and/or children, the following documentation, where applicable, should be submitted;

 

o       medical certificate, in respect of all applicants

o       marriage certificate or proof of spousal relationship

o       divorce decree, where applicable

o       proof of custody, where applicable

o       death certificate in respect of late spouse, where applicable

o       consent from parent(s), where applicable

o       proof of adoption, where applicable

o       proof of legal separation where applicable

o       police clearance certificate in respect of all applicants 21 years or older, in respect of all countries where person(s) resided one year or longer, to be submitted within twelve months of the application if not immediately available

o       additional information which may be requested for satisfaction of the existence of a good faith spousal relationship

6.   MEDICAL TREATMENT PERMIT

 

A Medical Treatment Permit may be issued to a foreigner intending to receive medical treatment in South Africa for longer than three months.

 

Documents and other information required in respect of application

 

q       Passport valid for not less than one month after the expiry of permit

q       Payment of the application fee of C$70-00 which is not refundable if the application has not been successful.

q       Proof of financial means to cover day to day needs of persons accompanying medical permit holder to South Africa, in the form of

o       Bank Statements

o       Salary advices

o       Cash available

o       Traveler’s cheques

 

q       A letter from the applicant’s medical practitioner or medical institution, indicating the reasons/necessity for treatment, the period of treatment and particulars of the treatment plans in the Republic.

 

q       An official letter of provisional acceptance from the treating institution stating the medical treatment for which the applicant has been admitted

 

q       Details of the person or institution responsible for the medical expenses and hospital fees.  Should the applicant’s medical scheme or employer not be liable for expenses incurred, proof of financial means or medical cover must be submitted.

 

q       Particulars of persons accompanying such permit holder.

q       In the case of a minor, the particulars of the person in the Republic who will act as the patient’s guardian, and proof of consent from both parents or from sole custody parent along with proof of sole custody.

 

q       Proof of booking of a return ticket or a refundable deposit of C$1000-00 is required in lieu of a return ticket.  This deposit is only refundable on production of the original receipt and only if the conditions of the permit have not been violated.

 

NB. Some medical institutions in South Africa who meet certain conditions can, through the registrars’ office or a designated official, issue a medical treatment permit to an applicant on behalf of the Department of Home Affairs. 

 

The following conditions should however be met, the institution must

 

q       have been approved by and is in good standing with the Department of Home Affairs

q       certify that it has received guarantees to its satisfaction that such foreigner’s treatment costs will be paid

q       undertake to provide a prescribed periodic certification to the Department of Home Affairs that such foreigner is under treatment

q       undertake to notify the Department of Home Affairs when such foreigner has completed his or her treatment

7          RELATIVE’S PERMIT

 

A relative’s permit may be issued by the Department of Home Affairs to a foreigner who is a member of the immediate family of a citizen or resident, provided such citizen or resident provides the prescribed financial assurance which shall consist of the following documentation;

 

q       certification by a chartered accountant confirming the sponsor’s and/or the joint means of support of the applicant and the sponsor, for the requested duration of the permit,

 

q       the minimum amount required in respect of the above shall be R5 000-00 per month per  person, which shall not apply in the case of a spouse or dependent minor child

 

q       The period of validity of the permit shall be determined by the financial assurance provided, but will not exceed a period of 24 months at a time.

 

q       A relative’s permit issued to a spouse shall lapse upon the dissolution of the spousal relationship

·        Bank statements, salary advices, cash available including credits to cover envisaged living expenses during the sojourn in the Republic

q       Marriage certificate, where applicable

q       Proof of a spousal relationship, where applicable

q       Divorce decree, where applicable

q       Death certificate in respect of late spouse, where applicable

q       Proof of legal separation, where applicable

q       Police clearance certificates in respect of all applicants 21 years or older, in respect of all countries where the applicant has resided one year or longer, to be submitted within twelve months of the application if not immediately available

8.   TREATY PERMIT

 

A treaty permit may be issued to a foreigner conducting activities in South Africa in terms of an international agreement to which South Africa is a party.   A treaty permit shall be issued by means of an endorsement in the passport of the applicant.  The Treaty permit shall be issued by the Department of Home Affairs;

 

q       after having verified that such an applicant falls within the specifically intended class of persons covered by such agreement or treaty

 

q       subject to terms and conditions which reflect the provisions and purposes of such treaty or agreement and of such foreigners and of such foreigner’s sojourn to or activities in South Africa

 

q       in such a manner that such foreigners compliance with the immigration laws and permit’s terms and conditions may be monitored

 

A treaty permit may also be issued by the Department of Foreign affairs or the other organ of State responsible for the implementation of the treaty concerned under a delegation from the Department of Home Affairs, provided that;

 

q       information relating to the failure of such foreigner to comply with the terms and conditions of the permit and to depart when required, is conveyed to the Department;

 

q       the organ of State concerned satisfies the Department that, under the circumstances, it has the capacity to perform this function; and

 

q       such organ of state ensures that the requirements, procedures and forms for the issuance of such permit are complied with, including the processing of the relevant application on behalf of the Department of Home Affairs, provided that

 

q       Copies of all processed applications shall be sent to the Department of Home Affairs, and at anytime the Department may elect to process an application.

 

DOCUMENTS AND OTHER INFORMATION REQUIRED IN RESPECT OF APPLICATION FOR A TREATY PERMIT

 

 For submission of application, Annexure 14  (APPLICATION FOR TEMPORARY RESIDENCE), must be completed

 

q       Passport valid for no less than 30 days after the expiry of the permit

q       Payment of the non-refundable application fee of C$70-00

q       Proof of financial means

q       Proof of booking of a return air-ticket or cash deposit of C$1000-00, refundable only if visa/permit conditions have not been violated and the original receipt is presented.

 

If accompanied by spouse and /or child(ren) the following is required

 

q       Marriage certificate or proof of spousal relationship

q       Proof of custody, where applicable

q       Proof of adoption, where applicable

q       Police clearance certificate in respect of all applicants 21 years or older, in respect of all countries where persons resided one year or longer, to be submitted within twelve months of the application if not immediately available

           

q       A letter from the relevant organ of State attesting to

 

o       The nature of the programme and the treaty under which it is conducted

o       The fact that the relevant foreigner participates in such programme

o       The type of activities which the foreigner participates in such programme

o       The type of activities which the foreigner is expected to perform under such programme and the duration thereof and whether he or she is expected to conduct work

9.         RETIRED PERSON PERMIT

 

A retired person permit may be issued for a period exceeding three months to an applicant who intends to retire in South Africa.  For submission of application Annexure 14  (APPLICATION FOR TEMPORARY RESIDENCE), must be completed.

 

To qualify for this type of permit, the applicant must provide proof that he/she has;

 

q       The right to a pension of R25 000-00 per month or an irrevocable annuity or retirement account to the equivalent amount; OR

 

q       A minimum prescribed net worth which shall not be less than R15 000 000-00 yielding an income of at least R25 000-00 per month

 

q       The following additional documents and information is required in respect of applicant and members of family accompanying him/her

 

Medical certificate in respect of all applicants

 

q       Police clearance certificates in respect of all applicants 21 years or older, in respect of all countries where person(s) resided one year or longer, to be submitted within twelve months of the application if not immediately available

 

q       Unabridged Birth Certificates I.R.O of Children under 21 years old

 

q       Marriage certificate or proof of spousal relationship

 

q       Divorce decree, where applicable

 

q       Proof of custody, where applicable

 

q       Death certificate in respect of late spouse where applicable

 

q       Proof of adoption, where applicable

 

q       Proof  of legal separation, where applicable

 

q       Payment of a non-refundable application fee of C$

 

q       Passport valid at least 30 days after the expiry of permit
