New South African Immigration Act

A
visa only enables the holder to proceed to a port of entry before or on the
expiry date of the visa, where the holder must comply with the applicable law,
regulations and entry requirements.Where a visa was issued outside the Republic,
upon admission such visa shall be considered to be a permit.
The period of validity of such a permit shall be calculated from the date
of admission and shall not exceed three months.
The period for processing visa is ten days. Only bank guaranteed cheques
or money orders made payable to the South African High Commission are accepted.
Annexure 2 (Application for a visa) should be completed for both Visitors
and Transit Visa

WORK PERMIT

2.2
Work Permit (General Quota)

submission of a certificate of a
Chartered Accountant confirming that applicant under this category of work
permit are to be employed on terms and conditions not inferior to those offered
to citizens and residents or prevailing in the relevant market segment taking
into account collective bargaining agreements and other standards, if any;
q
commitment by the employer to
comply with the requirement, in respect of a foreigner issued with the quota
permit, to pay a training fee in respect of the applicant amounting to two
percent of his or her taxable remuneration to be paid quarterly in advance. The Minister of Home Affairs shall determine the revision and
the manner in which this money will be collected.
q
Certification by a Chartered
Accountant, that the terms and conditions under which the employer intends to
employ the applicant (candidate), including salary and benefits, are not
inferior to those prevailing in the relevant market segment for citizens and
residents, taking into account applicable collective bargaining agreements and
other applicable standards, as recorded by the Department of Labour, if any,
provided that;
o
a copy of such certification shall
be conveyed to a prescribed office of the Department of Labour and;
o
such certification shall lapse if
objected to for good cause by such office of the Department of Labour within 15
calendar days of its receipt

2.3
Work Permit (Extraordinary
Quota)
A
quota work permit may be issued to an applicant who has skills or qualifications
which fall within a category determined by the Minister of Home Affairs by
public notice in the government gazette on recommendation of the board and after
consultation with the Ministers of Labour and Trade and Industry, under the
following provisions;
q
the number of quota work permits
issued may not exceed set out in such notice for each category set out in such
notice
q
In making its recommendation, the
Board shall give due consideration to the objectives of the Act, and shall
satisfy itself certain needs of the of the economy require resorting to quota
work permits in terms of the other provisions of this regulation;
q
The foreigner issued with a quota
work permit in terms of the paragraph shall be authorized to conduct work;
o
even when at the time the permit is
issued he or she does not have a prospective employer;
o
outside of such category, unless
the Minister determines otherwise in such notice
o
without complying with the
requirements set out in the regulation, save that within thirty calendar days of
such foreigner becoming employed in terms relevant sub-regulations, referring to
certificate by a Chartered Accountant shall be complied with

at least 150 millimeters by 90 millimeters

included in the certification contemplated in (v) above.

2.7.2
WORK PERMIT (CORPORATE
WORKER) in respect of seasonal labour (section 21.4C)
In
consultation with the Minister of Trade and Industry or Minerals and Energy or
Agriculture, as the case may be, the Minister of Labour may designate certain
industries, or segments thereof, in respect of which the Government may apply
this subsection in respect of foreigners required for seasonal or temporary peak
period employment.

CORPORATE PERMIT
(CORPORATE APPLICANT)

Certification prepared by the
Chartered Accountant, on the basis of the relevant prescription or information
of the Department of Labour, if any, that at any given time the relevant
foreigners are employed on terms and conditions not inferior to those offered to
citizens and residents or prevailing in the relevant market segment, taking into
account collective bargaining agreements and other standards, if any.
The certificate should contain the organizational diagram of the relevant
productive unit, including the staff’s residential status and job’s
description
q
Undertaking by the corporate permit
that it will;
o
take adequate or prescribed
measures to ensure that any foreigner employed in terms of the corporate permit
will at any time comply with the provisions of the Act and corporate permit;
o
immediately notify the Department
if it has reason to believe that such foreigner is no longer in compliance with
above paragraph
q
Training fee and/or an undertaking
to implement the training programme for citizens and residents aimed, to the
satisfaction of the Department, at reducing the corporate applicant’s
dependency on foreign labour and/or at transferring skills from foreigners to
residents and citizens, if any.
q
Undertaking by the corporate
applicant, to ensure;
o
that the passport(s) of the
foreigner/s are valid for no less than 30 days after the expiry date of the
intended stay,
o
that foreigners are only employed
in the specific positions as authorized by the corporate permit and
o
the forthwith departure of such
foreigner from South Africa on completion of their tour of duty

Corroborated representations made
by the corporate applicant in respect of the need to employ foreigners, their
job descriptions, the number of citizens or residents employed and their
positions, and other prescribed matters,

Undertaking by the corporate
applicant to provide training programme to South African citizens and residents
in order to reduce its dependency to foreigners and payment of the prescribed
training fee per foreigner to the Department of Home Affairs.

A deposit in the amount of $1000 CDN (money order or bank draft only) will be payable to the South African High Commission for all periods of study exceeding twelve months. This amount will be refunded on the applicant’s permanent return to Canada as long as the conditions of the permit, or subsequent permits are not violated.

Business
Permit is applicable for business activities of longer than three months.
Annexure 14 (APPLICATION FOR TEMPORARY RESIDENCE), must be completed.
Business
permit may be issued for more than one entry, if multi entries into the Republic
by that over a period of time are necessary. A business permit shall be issued
to a foreigner intending to establish, or invest in a business in South Africa
in which he or she may be employed. The business permit can be issued to members of such a
foreigner’s immediate family in accordance with the following requirements;

Details of the person or
institution responsible for the medical expenses and hospital fees.
Should the applicant’s medical scheme or employer not be liable for
expenses incurred, proof of financial means or medical cover must be submitted.

Particulars of persons accompanying
such permit holder.
q
In the case of a minor, the
particulars of the person in the Republic who will act as the patient’s
guardian, and proof of consent from both parents or from sole custody parent
along with proof of sole custody.
q
Proof of booking of a return ticket
or a refundable deposit of C$1000-00 is required in lieu of a return ticket.
This deposit is only refundable on production of the original receipt and
only if the conditions of the permit have not been violated.
NB.
Some medical institutions in South Africa who meet certain conditions can,
through the registrars’ office or a designated official, issue a medical
treatment permit to an applicant on behalf of the Department of Home Affairs.
The
following conditions should however be met, the institution must
q
have been approved by and is in
good standing with the Department of Home Affairs
q
certify that it has received
guarantees to its satisfaction that such foreigner’s treatment costs will be
paid
q
undertake to provide a prescribed
periodic certification to the Department of Home Affairs that such foreigner is
under treatment
q
undertake to notify the Department
of Home Affairs when such foreigner has completed his or her treatment

A
relative’s permit may be issued by the Department of Home Affairs to a
foreigner who is a member of the immediate family of a citizen or resident,
provided such citizen or resident provides the prescribed financial assurance
which shall consist of the following documentation;

accountant confirming the sponsor’s and/or the joint means of support of the
applicant and the sponsor, for the requested duration of the permit,
q
the minimum amount required in
respect of the above shall be R5 000-00 per month per
person, which shall not apply in the case of a spouse or dependent
minor child

The period of validity of the
permit shall be determined by the financial assurance provided, but will not
exceed a period of 24 months at a time.
q
A relative’s permit issued to a
spouse shall lapse upon the dissolution of the spousal relationship

A
treaty permit may be issued to a foreigner conducting activities in South Africa
in terms of an international agreement to which South Africa is a party.
A treaty permit shall be issued by means of an endorsement in the
passport of the applicant. The
Treaty permit shall be issued by the Department of Home Affairs;
q
after having verified that such an
applicant falls within the specifically intended class of persons covered by
such agreement or treaty
q
subject to terms and conditions
which reflect the provisions and purposes of such treaty or agreement and of
such foreigners and of such foreigner’s sojourn to or activities in South
Africa
q
in such a manner that such
foreigners compliance with the immigration laws and permit’s terms and
conditions may be monitored
A
treaty permit may also be issued by the Department of Foreign affairs or the
other organ of State responsible for the implementation of the treaty concerned
under a delegation from the Department of Home Affairs, provided that;
q
information relating to the failure
of such foreigner to comply with the terms and conditions of the permit and to
depart when required, is conveyed to the Department;
q
the organ of State concerned
satisfies the Department that, under the circumstances, it has the capacity to
perform this function; and
q
such organ of state ensures that
the requirements, procedures and forms for the issuance of such permit are
complied with, including the processing of the relevant application on behalf of
the Department of Home Affairs, provided that
q
Copies of all processed
applications shall be sent to the Department of Home Affairs, and at anytime the
Department may elect to process an application.

Annexure14 Application for a Visa
A
retired person permit may be issued for a period exceeding three months to an
applicant who intends to retire in South Africa. For submission of application Annexure 14
(APPLICATION FOR TEMPORARY RESIDENCE), must be completed.
To
qualify for this type of permit, the applicant must provide proof that he/she
has;

The right to a pension of R25
000-00 per month or an irrevocable annuity or retirement account to the
equivalent amount; OR
q
A minimum prescribed net worth
which shall not be less than R15 000 000-00 yielding an income of at least R25
000-00 per month
q
The following additional documents
